Terms, Conditions & Waiver of Liability
Digital Agreement — Accepted at Time of Purchase

By checking the box below and completing your ticket purchase, you (“Participant”) acknowledge that you have read, understood, and agree to all of the following terms and conditions. This agreement is legally binding.

No-Refund Policy
All ticket sales and vendor registration payments are final and non-refundable for any reason whatsoever, unless otherwise determined at the sole discretion of Essential Rhythms Festival management. By completing your purchase, you expressly acknowledge and accept this no-refund policy.

Waiver and Release of Liability
In consideration of the risks inherent in attending and participating in the Essential Rhythms Music & Arts Festival 2026 (the “Event”), held at Weeks Bay Plantation, 12562 Mary Ann Beach Road, Fairhope, Alabama 36532, and as consideration for the right to participate in the Event, you hereby knowingly and voluntarily agree to the following on behalf of yourself, your heirs, executors, administrators, assigns, and personal representatives.
1. Assumption of Risk
You are voluntarily attending and participating in the Event entirely at your own risk. You acknowledge that participation in the Event — including attending performances, engaging in activities, and traveling to and from the venue — may involve risks including, but not limited to: physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. You understand that these risks may arise from your own actions, the actions of others, conditions related to travel, weather, terrain, facilities, equipment, vehicular traffic, or the condition of the Event location. You assume all related risks, both known and unknown, associated with your participation in the Event.
2. Release of Liability
You hereby release and forever discharge Essential Rhythms Festival and Weeks Bay Plantation, along with their respective affiliates, managers, members, directors, officers, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns (collectively, the “Released Parties”), from any and all rights, claims, or causes of action of any kind arising out of your participation in the Event, including travel to and from the Event. This release includes claims arising from physical or psychological injury, illness, paralysis, death, economic loss, or emotional loss, whether caused by the negligence of the Released Parties or otherwise, to the extent permitted by applicable law.
3. Indemnification
You agree to indemnify and hold harmless the Released Parties against any and all claims, suits, or actions of any kind for liability, damages, compensation, or otherwise brought by you or on your behalf, including attorney’s fees and related costs. If the Released Parties incur any such expenses as a result of claims made by you or on your behalf, you agree to reimburse them in full.
4. Medical Care and Financial Responsibility
In the event that you require medical care or treatment as a result of your participation in the Event, you agree to be financially responsible for all costs incurred. You acknowledge that you should carry your own health insurance and that the Released Parties bear no responsibility for medical expenses arising from your participation.
5. Damage to Property
If any damage to equipment, facilities, or property occurs as a result of your or your family’s willful actions, neglect, or recklessness, you agree to be held liable for all costs associated with such damage.
6. Acknowledgment of Conditions
You acknowledge that the Event may involve activities that test physical and mental limits, and that potential risks include those caused by terrain, facilities, temperature, weather, dehydration, equipment failure, and the actions of other participants, spectators, volunteers, officials, and event producers.
7. Photography, Video & Media Release
By attending the Event, you acknowledge and consent that Essential Rhythms Festival and its authorized representatives may photograph, film, record, or otherwise capture your image, likeness, voice, and appearance during the Event. You grant Essential Rhythms Festival a perpetual, royalty-free, worldwide license to use, reproduce, distribute, and display such photographs, video recordings, and audio recordings in any media format, including but not limited to promotional materials, social media, documentary or archive videos, website content, and future marketing materials, without further notice, compensation, or consent. If you do not wish to be filmed or photographed, it is your responsibility to notify festival staff on-site and avoid areas where filming or recording is actively taking place.
8. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. If a court determines that any provision can be made valid by limiting its scope, that provision shall be construed and enforced as so limited.
9. Entire Agreement
This Agreement was entered into freely, without duress or coercion, and represents the entire understanding between the parties with respect to the subject matter herein. Both parties agree that this Agreement is clear and unambiguous and shall be interpreted according to its plain language in accordance with the purposes for which it was entered into. Your electronic acceptance of this Agreement at the time of ticket purchase constitutes a valid and binding signature under applicable electronic signature laws.

I have read and agree to the Essential Rhythms 2026 Terms, Conditions & Waiver of Liability. I understand this is a release of liability, I am 18 years of age or older (or am the parent/legal guardian of the ticket holder), and I accept all terms stated above on behalf of myself and any minor in my care attending the Event.
